Chinese Copyright Law for Music — Context and Key Points
To read music copyright in China, hold onto a few local anchors

The same music-copyright question has similar structures and different details in China and in the West. For readers of this knowledge matrix, a few local anchors are worth nailing down.
(Context, not legal advice.)
The legal backbone
China's music copyright system stands on the Copyright Law, with implementing regulations, judicial interpretations and administrative rules beside it. Its orientation leans toward the civil-law tradition: author-centred, with moral rights explicitly listed (see moral and economic rights).
The music-relevant essentials, as a small map:
- Objects: musical works (words and music), sound recordings, performances — the three-layer structure, in step with the world;
- Content: reproduction, distribution, performance, broadcast, network communication, listed item by item;
- Limits and exceptions: fair use (closed list) plus statutory licences (specific cases);
- Collective management: the legal status and rules of MCSC, CAVCA and peers (see performance rights and collective management).
Three local anchors
1. Legitimisation is recent: from piracy-dominant circulation at the century's turn to full platform licensing and normalised rights purchasing — today's order in China is a short, steep history (see the Chinese music market); 2. Platform liability draws close attention: the notice-and-takedown rules and platforms' duty of care are among the most active areas of Chinese practice; 3. Collective management is institutionally framed: China's collectives operate under dedicated rules — unlike the West's "several competing societies" model.
Two cross-border reminders
- Territoriality: scope, duration and exceptions follow the place of use — China is party to the Berne Convention and others, but what counts as an exception differs in detail;
- Evidence thinking: in cross-border disputes, the completeness of the rights chain (creation → licence → assignment) often decides outcomes.
For the everyday reader
- Daily use: run this site's C2 checklist (layer → duration → place → version);
- Real projects: for money-on-the-table licensing, consulting professionals is always the cheapest step.
