Fair Use and Fair Quotation — Where the Line Runs
"Not sued" is not "legal" — fair use is a narrow door
Related
"I only quoted a little", "I made no money", "I credited the source" — the three most spoken lines in copyright arguments, and none of them is a free pass. The truth about fair use: it is a narrow door, and the mechanism at the door differs by country.
(An introduction to the rules; not legal advice.)
Two legislative roads
- China: enumerated(closed list). The law lists specific situations where use needs neither permission nor payment (personal study, appropriate quotation, news reporting, teaching and research, etc.), plus a catch-all. "It feels fair" beyond the list is usually not supported.
- The United States: an open standard(four factors). Whether something is fair use is judged by: ① purpose and character (transformative? commercial?) ② nature of the work ③ amount and substantiality used ④ effect on the original's market.
Both incorporate the international "three-step test": special cases only + no conflict with normal use + no unreasonable harm to the rightsholder.
Three popular misunderstandings
1. "Non-commercial = safe." Wrong. Commerciality is one factor (in the US) and does not enlarge China's closed list; 2. "I credited the source." Wrong. Attribution respects moral rights; it is not a licence; 3. "Only fifteen seconds." Short is not automatically safe. What you took (the most memorable hook) may matter more than how much.
A sense of scale for practice
Not legal standards — risk-management rulers:
- Quotation to make a point (criticism, teaching, research) sits far safer than quotation as decoration or bait;
- More transformative, safer (you give the material a new job); more substitutive, riskier (you do the original's job);
- For short-video soundtracks, the most dangerous move is "unaltered + commercial account + full track" — three factors stacking, and fair use is almost surely gone.
The easy way out
Rather than studying exactly where the line runs, use material that needs no line-drawing: openly licensed music, public-domain works, royalty-free libraries (see the licensing family). The safest compliance is never walking the contested road.
Listen: the sound of "a little"
The first three notes: a minimal quotation. The question was never "how short is short", but — is this the part the original is worth most for.
Next
- A choice that skips the line entirely: the CC licence family.
- A harder boundary case: sampling and transformation.
- What is being quoted: Melody.
