Neighbouring Rights — Performers and Producers
Copyright protects creation; neighbouring rights protect those who turn it into sound
Related
If copyright protects those who write the music, neighbouring rights protect those who play it and record it — not composers of melody, but work the system equally recognises.
(Rules, not legal advice.)
Three households under the roof
In Chinese law, rights "related to copyright" have three main residents:
1. Performers (actors, singers, players): rights in their own performances; 2. Producers of sound/film recordings: rights in the recordings they make; 3. Broadcasters: rights in the signals they broadcast.
Why "neighbouring": they sit next to copyright — derived from the same works, but not the same rights.
Performer's rights: more than "the one who sings"
Performers' rights split in two as well:
- Personal side: to be identified as performer, to have the performance image protected from distortion;
- Economic side: to authorise live broadcast, recording, reproduction and distribution, network transmission — and be paid.
A common misunderstanding: "the writer agreed, so any version of the singing is free" — not necessarily. The work layer and the performance layer license separately (add the recording layer and it is three; see how many rights live in one song).
Producer's rights: the label's layer
Producers hold reproduction, distribution, rental and network-transmission rights in their recordings — every audio file on a platform has this layer standing behind it.
Why everyone should know a little
- Releasing a cover: besides the work layer, using the original backing track (= the original recording) needs the recording layer too;
- Reposting live footage: may touch both performers and producers;
- Remixing and sampling: every layer must be cleared (see sampling and transformation).
One-line mnemonic: song, performance, recording — three layers, three owners; greets each in turn.
Listen: one material, a different rendering
The same melodic material, played by another person or processed differently, is another product — and that is exactly the layer neighbouring rights protect.
