Covering vs Copying — Two Different Tracks
Re-singing and copying a recording are legally different acts
Related
"I want to cover this song" — choose first: re-sing it (a cover) or take the original recording (a copy)? Two tracks, two different sets of gates.
(Rules, not legal advice.)
Track one: the cover (re-recording)
You are using the work layer. The gates:
- Obtain a licence for words and music — usually via a collective management organisation or the publisher;
- Pay the due royalties — by the agreed settlement;
- Meet duties such as attribution.
A special arrangement easily missed: for musical works already lawfully recorded as sound recordings, Chinese law gives re-recording a particular channel (one of the statutory-licence situations — with conditions: the rightsholder may declare prohibition, and payment is required). Check the current text for real cases — "a special channel exists" never means "nothing to handle".
Track two: the copy (using the original)
Using the original recording (in a video, as a bed, in a mashup) calls at the recording layer (plus the work layer):
- Clear with the producer (label, etc.);
- Typically as two licences: sync + master (see the licensing family).
The dividing line is common sense: what your voice sings is the work; what you play back is the recording.
Field questions
- "I post covers on short-video platforms": platforms and collectives often have umbrella arrangements — following the platform flow and letting it settle is the compliant path;
- "I use the original backing track": that backing *is* the original recording — you have stepped onto the recording layer, one gate more than a pure cover;
- "I changed the words/music": now you are in adaptation territory, a separate set of rights (see moral and economic rights);
- "It is non-commercial": non-profit is not an automatic pass (see fair use).
A minimal action list
1. Decide the layer (work? recording? both?); 2. Find the collective / platform flow / rightsholder for it; 3. Keep proof of licence and settlement; 4. When unsure, choose the dispute-free path (openly licensed or public-domain material).
Listen: two fiddles on one tune
The same notes, sung or played, differ in character — exactly like a cover versus an original: one work layer, two different products.
